What Does

the EB-1A 

Green Card Do?

The EB-1A Green Card allows you to live and work in the US permanently on the basis of your extraordinary ability. You do not need a job offer; you are permitted to work for any US employer or be self-employed, but you must be entering the US to continue work in your area of extraordinary ability. You will be eligible for citizenship after residing in the US for 5 years.

Qualifying for an EB-1A based on extraordinary ability is not easy. The law describes these individuals as "one of that small percentage who have risen to the very top of the field of endeavor." In order to meet that standard, applicants should meet at least 3 of the 10 the following criteria:

  • Receipt of lesser nationally or internationally recognized prizes or awards for excellence;

  • Membership in associations in the field which demand outstanding achievement of their members;

  • Published material about you in professional or major trade publications or other major media;

  • Being asked to judge the work of others, either individually or on a panel;

  • Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field;

  • Authorship of scholarly articles in professional or major trade publications or other major media;

  • Your work has been displayed at artistic exhibitions or showcases;

  • You perform a leading or critical role in distinguished organizations;

  • You receive a high salary or other significantly high remuneration in relation to others in the field;

  • You have had commercial successes in the performing arts.

If you can demonstrate that you meet at least 3 of these criteria, then you may qualify for a Green Card based on your extraordinary ability.
